Summary

The terms on which you use Cuabity — the free courses, the paid certificate assessments, and the certificates themselves.

Full policy

1.Who we are

The platform is operated by Kuiper Belt Works Pty Ltd trading as Cuabity (ACN 703 421 505, ABN 83 703 421 505), a company incorporated in Australia.

In these terms, we, us, our and Cuabity mean Kuiper Belt Works Pty Ltd. You means the person using the platform. The platform means the Cuabity website, the courses and assessments on it, and the certificates it issues.

2.These terms

What they cover. These terms apply to the public platform: the courses in our public catalogue, the certificate assessments sold on the platform, and the certificates those assessments issue.

Private training and services are not covered by these terms. Private courses, training adapted for an organisation, Quality support and any other service we provide to an organisation — on the platform or outside it — are governed by a separate written agreement with that organisation, agreed before the work begins. That agreement governs the service it describes, and where it differs from these terms, it prevails for that service.

If you have access to a private course through your organisation, your organisation's agreement with us governs that access. These terms still apply to your own use of your account and the platform — sections 4, 10, 12 and 20 — unless that agreement says otherwise.

By creating an account, enrolling in a course, or buying an assessment, you agree to these terms. If you do not agree to them, do not use the platform.

We may change these terms. If a change materially affects you, we will give notice by email to the address on your account and by a notice on the platform, at least 14 days before it takes effect. Changes do not apply retrospectively to an assessment you have already bought: the terms that govern a purchase are the terms in force when you made it, and we keep the superseded versions so that can be established.

If you buy public-catalogue assessments on behalf of an organisation, you confirm you are authorised to bind that organisation, and these terms apply to it as well as to you.

3.Who may use Cuabity

Cuabity is built for adults working in, or preparing to work in, regulated manufacturing. You may create an account if you are at least 16 years old. You may buy an assessment only if you are at least 18 years old and can enter a binding contract.

The platform is not directed at children, and we do not knowingly collect personal information from anyone under 16. If we learn that we have, we will delete the account.

You are responsible for complying with the laws of the country you use the platform from. We make the platform available internationally, but we do not represent that its content is appropriate or available in every jurisdiction.

4.Your account

  • Register with your own accurate details, and keep them up to date. A certificate carries the name on your account, so a name that is not yours produces a certificate that is worthless.
  • Keep your password confidential. You are responsible for what happens under your account.
  • One account, one person. Accounts must not be shared, sold or transferred. Assessments are individual, and so are the certificates that come from them.
  • Tell us promptly if you believe your account has been used without your authority.

Where an organisation buys public-catalogue assessments for its people, each person needs their own account, because assessments and certificates are individual. Anything beyond the public catalogue is arranged under a separate agreement (section 2).

5.What we provide

Cuabity provides two different things, and the difference matters:

Courses — free
The course material: reading pages, worked examples, narrated explainer videos, decision scenarios, downloadable templates, and knowledge checks. These are free to use, with no payment and no time limit, for as long as we run the platform.
Certificate assessments — paid
A graded examination and, if you pass it, a dated certificate that anyone can verify. This is what you pay for. You are not buying the course material, and you do not need to buy anything to learn from it.

Buying an assessment gives you access to that assessment, and to the certificate it can issue, for 365 days from the date of purchase, subject to the attempt limits stated on the course.

6.What a Cuabity certificate is, and is not

This section is the most important one in this document, and we would rather over-explain it than have anyone rely on a certificate for something it cannot carry.

What it is. A record that one named person passed one named Cuabity assessment on one date, at the stated pass mark, verifiable by anyone through the verification page using the certificate code.

Certificates do not expire. A certificate records that you passed on the date it shows. How recent a certificate must be for a given purpose is for whoever relies on it to decide — your employer's training procedure, for example. If you want a newer one, such as for an annual refresher, you can buy the certificate course again at its price at the time and sit the assessment: a pass issues a new certificate dated that day, and the earlier one stays on record and continues to verify.

What it is not:

  • It is not an accreditation and not a recognised or regulated qualification.
  • It is not issued, endorsed, approved or recognised by PIC/S, ISO, the TGA, the FDA, ANVISA, the MHRA, the EMA or any other regulator, standards body or accreditation authority. Cuabity is independent of all of them. Where a course is assessed against a published document, that is a statement about the syllabus, not a claim of endorsement.
  • It is not evidence of competence to perform any task, and not a licence, registration or authorisation to do anything.
  • It is not a substitute for the training your employer is required to provide, for your organisation's own qualification and assessment of you, or for any regulatory approval or sign-off.

Nothing about a Cuabity certificate transfers responsibility for a compliance decision from your organisation to us. Those decisions remain your organisation's own.

7.Course content and its sources

Course content is educational. It is not regulatory advice, legal advice, or advice on your particular circumstances, and must not be used as a substitute for reading the source document, your own approved procedures, or advice from a qualified professional.

Our courses teach documents published by other organisations. Those documents are owned by their publishers, and their copyright is theirs. Each course names the exact document and revision it was written against. Where the publisher sells that document — ISO standards, for example — the course explains it in our own words and quotes it only where the exact wording is the point: a word or a short phrase, in quotation marks, with its clause number. Standards published by ISO and others must be obtained from the publisher; nothing on Cuabity gives you a licence to any third-party document.

Guidance changes. A course states the revision it was written against and the date of its last content review, and we work to keep courses current, but we do not warrant that any course reflects the latest revision of a document, or the law of your jurisdiction, at the moment you read it. Always check the source.

8.Buying an assessment

  • Prices are shown on the platform in Australian dollars (AUD) and are the amount you pay us. Your bank or card issuer may apply its own conversion rate and fees, which we do not receive and cannot control.
  • Payment is taken by Stripe, our payment processor. We do not receive or store your full card details. Stripe's own terms apply to the payment itself.
  • Your purchase is complete, and access begins, when the payment is confirmed.
  • Taxes: the price shown at checkout is the total amount you pay, including any GST or other tax that applies to the sale.
  • We may change prices at any time. A change never affects a purchase already made.

Free places. We sometimes give a certificate assessment or a bundle free of charge — for example, to invite honest feedback when a course launches. A free place is the same as a bought one: the same access period, attempts, free re-sit and certificate, and the same rules, including section 10. It is personal to you, cannot be transferred or exchanged for money, and, as nothing was paid, there is nothing to refund. Accepting one never obliges you to review, recommend or post about Cuabity, and we never make it depend on what you say. If you do mention it publicly, please say that you received it free.

9.Refunds

Refunds are governed by our Refund Policy, which forms part of these terms. In short: a full refund within 14 days of purchase provided you have not submitted an exam attempt — and, separately and always, whatever rights the consumer law of your country gives you, which we do not attempt to limit.

10.Assessment integrity

A certificate is only worth something if the assessment behind it was sat honestly. When you sit a Cuabity assessment you agree that:

  • you will complete it yourself, without help from another person;
  • you will not copy, photograph, record, republish or share the questions or answers, in any form or forum;
  • you will not use automated means to attempt, harvest or analyse an assessment;
  • you will not sit an assessment on behalf of anyone else, or ask anyone to sit one on your behalf.

Attempt limits, waiting periods between attempts, time limits and pass marks are stated on each certificate course, and form part of these terms for that purchase.

One free re-sit. Every purchase of a certificate assessment includes one re-sit. If you use all your attempts without passing, then once 30 days have passed since your last attempt, ask us and we will reset the exam once, at no further charge, within your access period. A re-sit is a fresh set of attempts, the same number you started with, with the usual wait between them. The wait is deliberate: sitting again straight away tests memory of particular questions rather than whether you can apply what the course teaches.

11.Revoking a certificate

We may revoke a certificate, without refund, where we reasonably conclude that it was obtained in breach of section 10, that the holder's identity was misrepresented, or that it was issued in error.

Before revoking, we will tell you why and give you a reasonable opportunity to respond, unless we are prevented from doing so by law. A revoked certificate stops verifying: the verification page no longer confirms it. We keep a record of the revocation, the reason and the date, and will confirm them to anyone who asks about that certificate. That is the point of a verifiable certificate, and it is the reason one is worth holding.

12.Acceptable use

You may use the platform for your own learning and, if you have bought one, your own assessment. You must not:

  • copy, scrape, mirror, bulk-download or systematically extract the course material or the question banks;
  • resell, sublicense, republish or redistribute any part of the platform, or use it to build a competing course or training product;
  • use it to train, fine-tune or evaluate a machine-learning model, or to generate derivative training material, without our written permission;
  • attempt to gain unauthorised access to any part of the platform, another account, or the systems behind it, or test its security without our written permission;
  • interfere with the platform's operation, or place an unreasonable load on it;
  • remove or obscure any attribution, source citation or disclaimer.

13.Intellectual property

The course material, question banks, explainer videos, scenarios, templates, illustrations, the Cuabity name and logo, and the platform itself are owned by us or licensed to us. Third-party documents that a course teaches remain the property of their publishers.

We grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the material for your own learning, and for the internal purposes of the organisation you work for. Downloadable templates may be adapted and used inside your organisation; they may not be resold or distributed as a product.

That licence ends if these terms end, except that anything you have properly downloaded and adapted for internal use may stay in use.

14.Material you submit

You keep ownership of anything you submit — enquiries, feedback, and any text you enter into an activity. By submitting it you give us a non-exclusive, royalty-free licence to use it for the purpose you submitted it for, and to use feedback to improve the platform.

Do not submit personal information about other people, confidential or commercially sensitive information belonging to your employer, or anything that infringes someone else's rights. Our activities are not a secure channel for confidential material and are not designed to hold it.

15.Availability and change

We aim to keep the platform available and working, but we do not guarantee uninterrupted access. Maintenance, updates, third-party failures and events outside our control can all interrupt it.

We may add, change, withdraw or retire courses and assessments. If we retire a certificate assessment you have paid for and you have not yet used it, we will refund it. Certificates already issued stay valid and stay verifiable — we will keep the verification service running for issued certificates for at least three years after issue, and will give notice on the platform if that is ever going to change.

16.Your statutory rights

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees, or any other right you have that cannot lawfully be excluded. Where we are permitted to limit our liability for a breach of a guarantee, our liability is limited to resupplying the service or paying the cost of having it resupplied.

If you are a consumer outside Australia, you keep any mandatory rights that the law of your own country gives you. Those rights sit on top of this agreement, and where our terms give you less than your local law requires, your local law wins. The Refund Policy sets out how refunds work in practice.

17.Our liability

Subject to section 16, and to the fullest extent permitted by law:

  • the platform and its content are provided as is, and we make no warranty that they are error-free, complete, current, or fit for a particular purpose;
  • we are not liable for indirect, incidental, special or consequential loss, loss of profit, loss of revenue, loss of opportunity, loss of data, or for any regulatory, disciplinary or business consequence arising from a decision you or your organisation made;
  • our total liability to you, for all claims arising in any 12-month period in connection with the platform, is limited to the total amount you paid us in that period — and, if you paid us nothing, to AUD 100.

Nothing in this section limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that cannot be limited by law.

18.Indemnity

You agree to indemnify us against loss we suffer arising from your breach of section 10 (assessment integrity), section 12 (acceptable use) or section 13 (intellectual property), or from your unlawful use of the platform. This does not apply to the extent the loss was caused by us, and it does not apply to ordinary consumer use of the platform.

19.Suspension and termination

You may stop using the platform and close your account at any time; see the Privacy Policy for what happens to your data.

We may suspend or close your account if you materially breach these terms. We will tell you why, and give you a chance to put it right where the breach can be put right. If we close your account for a reason that is not your fault, we will refund any assessment you have paid for and not used.

Closing your account does not by itself invalidate a certificate you properly earned, but note the interaction with erasure described in the Privacy Policy: if you ask us to erase your personal information, the certificate can no longer be verified, because verification depends on the record we would be erasing.

20.Privacy

How we handle personal information is set out in our Privacy Policy, which forms part of these terms. One point belongs here too, because it surprises people: a Cuabity certificate is publicly verifiable, which means that anyone holding the certificate code can see the holder's name, the assessment, and the date. That is what makes it worth anything. If you would rather that were not so, do not buy an assessment.

21.Complaints and disputes

If something has gone wrong, tell us first: email hello@cuabity.com with what happened and what you would like us to do. We will acknowledge within 5 business days and aim to resolve it within 30 days.

If we cannot resolve it between us, you keep every avenue the law gives you, including your national consumer protection authority. Nothing here requires you to give up a right to complain to a regulator or to go to court.

22.Governing law

These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts able to hear appeals from them.

"Non-exclusive" matters if you are outside Australia: it means this clause does not stop you bringing proceedings where your own mandatory consumer law allows you to.

23.General

  • Entire agreement. These terms, the Refund Policy and the Privacy Policy are the whole agreement between us about the platform.
  • Severability. If part of these terms is unenforceable, it is severed and the rest continues.
  • No waiver. If we do not enforce a right immediately, we do not give it up.
  • Assignment. You may not transfer your rights under these terms. We may transfer ours to a purchaser of the business, provided your rights are not reduced.
  • Force majeure. Neither of us is liable for a failure caused by an event genuinely outside our control.
  • Language. The English version of these terms is the governing version. Translations are provided for convenience.

Summary

What we collect, why we collect it, who else sees it, where it is kept, and what you can make us do about it.

Full policy

1.Who is responsible

Kuiper Belt Works Pty Ltd trading as Cuabity (ACN 703 421 505, ABN 83 703 421 505), a company incorporated in Australia, decides how and why the personal information described here is used, and is responsible for it.

We are bound by the Australian Privacy Act 1988 and its Australian Privacy Principles. People use our courses in many countries, and privacy laws differ between them. Rather than run a different standard for each, we apply one: the rights in section 9 are given to every user, wherever they live. If the law where you live gives you a right or protection this policy does not mention, you have it too, and we will honour it.

2.What we collect

Only what the platform needs. There is no tracking pixel, no advertising network and no data broker anywhere in this list.

CategoryWhat it isWhere it comes from
Account Your first and last name, a username, your email address and a password (stored only as a cryptographic hash, never in readable form). Optionally, your city and country. Your timezone and language preference, which you can change in your profile. Your confirmation that you are 16 or older, and — each time you buy an assessment — that you are 18 or older, with the time you gave it. We do not ask for your date of birth. You, at registration
Profile All optional: your company or organisation, how you heard about us, job function, industry sector, and organisation size. Whether you want marketing email (section 11) — and each time you tick or untick that box, when, the wording of the box as you saw it, and whether you or we made the change (for example, recording an unsubscribe). You, at registration or later
Learning Which courses you enrol in, which activities you complete, your knowledge-check and exam attempts including the answers you chose and the scores, and the badges and certificates you earn. If we give you a free exam re-sit or a free place on an assessment, a record of it: when, who gave it, and a short note of why. If you buy an assessment again, a record of the fresh attempts that came with it. If a certificate is revoked or withdrawn, a record of when and why (section 4). Generated as you use the platform
Certificates Your name, the assessment, the date, and a unique verification code. See section 4 — this one is public. Generated when you pass
Payments That a payment was made, what it was for, the amount, currency and date, and Stripe's references for the payment and for you as its customer. We never receive or store your card number. Stripe, our payment processor
Agreements Which version of the Terms of Service, this policy and the Refund Policy you accepted, and when. You, when you accept them
Technical Web server log entries: IP address, browser user-agent, the page requested, and the time. The platform's activity log: the pages you open and the actions you take on the platform, with your IP address and the time — linked to your account when you are signed in. The time of your first and most recent sign-in, and the IP address of your most recent one. Automatically, when you visit
Correspondence Emails and enquiries you send us, and our replies. You

We do not collect special-category or sensitive information — health, racial or ethnic origin, political or religious belief, sexual orientation, biometrics, or criminal records — and you should not send it to us.

What we do not have

No analytics. The site currently runs no analytics or statistics package of any kind. If we add one it will be self-hosted, it will not profile you across other websites, and we will update this policy and ask for consent where consent is required before it goes live.

3.Why we use it, and on what legal basis

PurposeLegal basis
Creating and running your account; giving you the courses; running the assessment; issuing and verifying your certificate Performance of a contract with you
Taking payment and keeping the financial record Contract, and legal obligation (tax and company law)
Keeping the platform secure, preventing fraud and cheating, and protecting the integrity of certificates Our legitimate interests — a certificate anyone could forge would be worth nothing to the people who earn one honestly
Understanding which courses are used and improving them Our legitimate interests, using aggregate figures rather than individual behaviour wherever we can
Sending you service email you cannot opt out of while you hold an account — password resets, receipts, certificate delivery, and material changes to these documents Contract
Reporting to an organisation on the private course it arranged for its own people (section 6) The legitimate interests of that organisation in knowing its training was completed, under our contract with it — limited to the fixed report in section 6, and never extended to the public platform
Sending you marketing email about new courses Your consent, which you give by ticking an unticked box and can withdraw at any time

We do not sell your personal information, and we never will. We do not share it with advertisers and we do not use it to build a profile of you for anyone else's purposes.

4.Public certificate verification — read this one

A Cuabity certificate is publicly verifiable. Anyone who has the certificate code — from the certificate itself, its QR code, or because you gave it to them — can open the verification page and see your name, the assessment you passed, and the date.

That is deliberate, and it is the whole value of the certificate: an employer or auditor can confirm it without asking us. It is also, unavoidably, a publication of your name.

  • The verification page is not a directory. There is no list of certificate holders, and no way to search by name — a code only shows the certificate it belongs to.
  • Your email address, profile details, exam answers and scores are never shown. Only name, assessment, date and status.
  • If you would prefer your name not to be published in this way, do not buy an assessment. If you have already bought one, contact us before you sit it and we will refund it.
  • You can ask us to withdraw a certificate from verification at any time. It then stops verifying for everyone, permanently — we cannot make it private to some people and public to others.

5.Automated grading

Your exam is marked automatically by the platform against a fixed answer key, and a certificate is issued automatically if you reach the pass mark. No human reviews it in the ordinary course.

If you believe a question was marked wrongly, you can ask us to review it. A person will look at the question, your answer and the key, and will correct the result if the marking was wrong. Email us using the address in section 17.

6.Who else sees it

We use a small number of service providers, each of which handles data on our instructions and for no purpose of their own — with the one exception for Stripe set out in the table:

ProviderWhat forWhere
Stripe Taking payment by card. When you buy an assessment we send Stripe your name, email address, username and account number on the platform, and what you are buying. Stripe collects your card details, the name on the card and your billing country directly from you, and gives us only the transaction record. Stripe also uses payment information for purposes of its own — detecting and preventing fraud, and meeting its own legal obligations — under its own privacy policy. Australia, Ireland and the United States
Hetzner Online GmbH Hosting the servers the platform runs on, and the encrypted backups. Germany and Finland (EU)
Zoho Corporation Pty Limited Our business mailboxes. When you email us, your message, your email address and anything you include are stored in our mailbox, together with our reply. Australia
Brevo SAS Delivering the emails the platform sends you: confirming your account, resetting your password, receipts, and notices about your courses and certificates. Brevo receives your name, your email address and the content of each email, and keeps a record of its delivery. European Union (France, Germany and Belgium)

We may also disclose personal information where the law requires it, to establish or defend a legal claim, or to a buyer if the business is sold — in which case the buyer is bound by this policy or one no less protective, and we will tell you before it happens.

Your employer does not get access to your account, your results or your activity on the public platform, even if they paid for your assessment.

The one exception is a private course an organisation has arranged with us for its own people (Terms of Service, section 2). If your organisation enrols you in one, it receives a report on that course only: your name, the course, the date you completed it, whether you passed and your score, and your certificate's code. You are told this when you are enrolled. It does not receive your answers, your individual attempts, or anything about the rest of your account or any other course.

7.Where your information is stored

Overseas storage — Australian Privacy Principle 8

We are an Australian company, but the platform runs on servers located in Germany and Finland, in the European Union. Your personal information is therefore stored outside Australia, and by using the platform you acknowledge that. We have taken reasonable steps to ensure our hosting provider handles it consistently with the Australian Privacy Principles.

Payment data is processed by Stripe in Australia, Ireland and the United States, under the data-transfer safeguards in Stripe's own data processing agreement. Whenever a service provider handles your information in another country, we use safeguards of that kind, and section 6 names the provider and the country.

Emails you send us, and our replies, are stored by our email provider in Australia. Emails the platform sends you are delivered by Brevo from the European Union.

8.How long we keep it

WhatHow longWhy
Account and profile While your account is open, then deleted within 30 days of closure It is yours; we have no reason to keep it once you leave
Learning and exam records Same as the account They exist to show you your own progress
Issued certificates At least 3 years from issue, and for as long as we offer verification A certificate that cannot be verified is not a certificate
Financial records of a purchase 5 years Required by Australian tax law; kept even if you close your account
Web server and platform activity logs 90 days Security, fault diagnosis and investigating misuse
Correspondence 2 years after the matter is closed So we can pick up a conversation, and answer a later dispute
Backups of the platform Daily copies 30 days; monthly copies 12 months; then destroyed So the platform can be restored after a failure. They are encrypted and used for nothing else

Information deleted from the platform — when you close your account, or at your request — remains in the encrypted backups until they are destroyed on that schedule, within 12 months at most. We do not restore it from a backup except to recover the platform after a failure, and if we ever have to, we delete it again.

9.Your rights

Wherever you live, you can ask us to:

  • Access the personal information we hold about you, and get a copy;
  • Correct anything inaccurate or out of date — you can edit most of it yourself in your profile;
  • Erase it (see section 10 for how this interacts with a certificate);
  • Restrict or object to what we do with it, including any processing based on our legitimate interests;
  • Receive it in a portable form — a machine-readable export you can take elsewhere;
  • Withdraw consent you have given, at any time, without affecting what was lawful before you withdrew it;
  • Complain to a regulator (section 15).

Email us at the address in section 17. We will respond within 30 days. We may need to verify your identity first, and we will not charge you for a reasonable request. If we cannot do what you ask, we will tell you why and what you can do about it.

10.Erasure and your certificate

There is a real trade-off here and we would rather set it out plainly than have you discover it later.

A certificate is verifiable because we hold a record linking your name to the assessment and the date. If you ask us to erase your personal information, that record goes too, and the certificate stops verifying — permanently. Anyone checking it afterwards will be told it cannot be verified. We cannot undo this, and we cannot reissue the certificate.

So when you make an erasure request we will tell you which certificates it will invalidate, and ask you to confirm. If you would rather keep them, you can instead close your account and ask us to erase everything except the certificate record, and we will keep only the minimum that verification needs: your name, the assessment, the date and the code.

We also keep financial records for 5 years regardless, because tax law requires it. Those are not used for anything else.

11.Marketing email

We send marketing email only if you ticked the box asking for it. The box is unticked by default and ticking it is never a condition of anything.

Every marketing email has a one-click unsubscribe, and you can change the setting in your profile at any time. Unsubscribing does not stop the service email described in section 3 — you cannot opt out of a password reset.

This is also what the Australian Spam Act requires, and we apply it to everyone, not only Australian recipients.

12.Cookies

The platform uses the minimum a logged-in site can work with:

  • Session cookie (MoodleSession) — keeps you logged in as you move between pages. Strictly necessary; the site cannot work without it. It expires when your session ends.

Your language choice is kept in that session, or in your profile once you are signed in — not in a separate cookie. The public pages outside the platform set no cookies at all.

That is all of them. There are no advertising cookies, no third-party trackers and no cross-site tracking of any kind, which is why you are not being asked to dismiss a consent banner. If we ever add anything that needs consent, we will ask for it properly before setting it — not after.

13.Security

  • All traffic is encrypted in transit (HTTPS).
  • Passwords are stored as salted hashes and can never be read by us, including by an administrator.
  • Administrative access is limited to the people who need it and protected by multi-factor authentication.
  • Backups are encrypted and held separately from the running system.
  • The platform software is kept patched against published security advisories.

No system is perfectly secure. If a breach occurs that is likely to cause you serious harm, we will tell you, and any regulator we are required to tell, without undue delay and within the time the applicable law sets — which in some countries is 72 hours.

14.Children

Cuabity is intended for adults working in regulated industry. Accounts require you to be at least 16, and purchases at least 18. We ask you to confirm each when you register and when you buy, and keep the time you did (section 2); we do not ask for your date of birth. We do not knowingly collect information from anyone younger, and will delete it if we find we have.

15.How to complain

Please raise it with us first, at the address in section 17 — we will acknowledge within 5 business days and respond within 30 days.

If you are not satisfied, you can complain to a data-protection regulator: the one in the country where you live or work, or ours — the Office of the Australian Information Commissioner (OAIC), oaic.gov.au. Nothing in this policy limits your right to do so.

No representative outside Australia

We have no office or appointed representative outside Australia. You can reach us directly using the contact details in section 17, and we answer requests from every country to the same standard and in the same time. We are keeping this under review as the platform grows.

16.Changes to this policy

We will update this policy when what we do changes — and, specifically, before we add analytics, before we change hosting provider, and before we add any new service provider that handles personal information.

If a change materially affects you, we will tell account holders by email and by a notice on the platform at least 14 days before it takes effect, so you have time to read it and, if you do not agree, to close your account first. The only exception is a change a law or an urgent security need requires sooner; we will then tell you as soon as we can, and why. Corrections that do not change what we do with your information are made without notice. Every version is kept, so you can see what changed and when.

1.The short version

Full refund within 14 days of purchase, as long as you have not submitted an exam attempt. After that, or once you have submitted an attempt, we do not refund a change of mind — but the consumer rights your own law gives you still apply in full (section 8).

We would rather you did not buy something you do not want, so: the whole course is free, the exam format is described on every certificate page, and you can work through the entire course and its knowledge check before spending anything. Almost nobody should need this policy.

2.Free courses

Every Cuabity course is free to learn. There is no payment, so there is nothing to refund and no risk in trying one. The same is true of a free place on a certificate assessment (Terms of Service, section 8).

3.What you are buying

When you pay, you are buying the graded assessment and the certificate it can issue — not the course material, which stays free either way. A purchase gives you access to that assessment for 365 days, with the number of attempts stated on the course and one free re-sit (section 5).

4.The refund rule

We will refund your purchase in full if both of these are true:

  • you ask within 14 days of the purchase; and
  • you have not submitted an exam attempt.

Submitting an attempt is the moment you consume what you paid for: you have seen the questions, and they cannot be un-seen. Opening the exam page and closing it again is not submitting an attempt — the clock we look at is the submission, which is recorded with a timestamp you can see in your own account.

No reason is required. You do not have to justify a change of mind, and asking does not affect anything else about your account.

SituationRefund under this policy
Bought 3 days ago, have not sat the examYes — in full
Bought 3 days ago, submitted one attemptNo — unless your own law gives you a cooling-off right (section 8)
Bought 20 days ago, have not sat the examNo — outside the 14 days
Sat the exam and failedNo — see section 5
Charged twice for the same purchaseYes — always, see section 7
The exam or certificate did not workYes — always, see section 7

5.Failing an exam is not grounds for a refund

Cuabity assessments are meant to be demanding — that is what makes passing one worth anything, and we say so before you buy. You get the number of attempts stated on the course, spaced apart so you can go back to the material in between, and the course that teaches the syllabus is free and stays open to you the whole time.

So a failed attempt is the product working, not a fault in it, and it is not refundable. What we will always do is check that the marking was right: if you think a question was scored wrongly, tell us and a person will review it.

And every certificate purchase includes one free re-sit: if you use all your attempts without passing, ask us once 30 days have passed since your last attempt and we will reset the exam once, at no further charge, within your access period. A re-sit is a fresh set of attempts, the same number you started with, with the usual wait between them (Terms of Service, section 10).

6.Bundles

A bundle is a single purchase that unlocks more than one certificate assessment. Each bundle's page lists the assessments it includes.

The refund rule in section 4 applies to a bundle as a whole: a full refund within 14 days of purchase, provided you have not submitted an attempt in any of the assessments it includes. Once you have, the bundle has been partly used, and we do not refund the rest of it, split it into parts, or refund it pro rata — a bundle is priced as a whole.

Apart from that, each assessment in a bundle is treated exactly as if you had bought it on its own: it has its own attempts and its own free re-sit (section 5), and it issues its own certificate. The access period runs from the date you bought the bundle. If section 7 entitles you to a refund for one assessment in a bundle, we refund that assessment's share of what you paid, in proportion to its price when sold on its own.

7.Refunds we always give

Outside the 14-day rule entirely, and regardless of attempts, we refund in full when:

  • you were charged more than once for the same purchase, or charged in error;
  • a technical fault on our side stopped you sitting the assessment or receiving the certificate, and we could not put it right in a reasonable time;
  • we withdraw or retire an assessment you have paid for and not used;
  • we close your account for a reason that is not your fault;
  • the assessment was materially not what we described it to be.

You do not need to invoke consumer law for any of these. Just tell us.

8.Your statutory rights

Everything above is what we offer voluntarily. It sits on top of the rights your own law gives you, which we do not attempt to limit, exclude or ask you to waive. Where your local law gives you more than this policy does, your local law wins.

Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion or compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion.

Cooling-off rights, wherever you live

In many countries, a consumer who buys online has a legal right to cancel within a set period after purchase — usually 7 or 14 days — for any reason, and to get back everything they paid. If the law where you live gives you a right like that, you have it in full, for as long as your law gives it, and we do not ask you to give it up: it applies even if you have already sat the assessment.

To use it, tell us within that period (section 9). You do not need a reason, and there is no form to fill in. We will refund you in full within 14 days of being told, or sooner if your law requires it.

If you tell us where you live, we will apply the more generous of your local law and this policy, without argument.

9.How to ask for a refund

Email hello@cuabity.com with:

  • the email address on your Cuabity account;
  • which assessment or bundle you bought, and roughly when;
  • if you live outside Australia, the country you live in — your own law may give you more than this policy does (section 8).

You do not need to give a reason, and you do not need to quote this policy at us. We will acknowledge your request within 5 business days, and within 14 days of receiving it we will either issue the refund or tell you why we cannot. If we say no, we will say why, and tell you what you can do next.

10.How refunds are paid

  • To the original payment method. We cannot pay a refund anywhere else.
  • In the original currency (Australian dollars). If your card issuer used a different exchange rate on the way out than on the way back, the small difference is theirs, not ours, and we cannot make it up.
  • Issued within 14 days of your request (section 9). Your bank usually takes a few more days to show it.
  • Your access to the assessment ends when the refund is issued. Any certificate issued from a refunded purchase is withdrawn and stops verifying.

11.Chargebacks

If something is wrong, please ask us before asking your bank. If you are entitled to a refund under this policy or your own law, asking us is usually the quickest way to get it: we answer within the times in section 9, whereas a card dispute can take weeks or months to be decided, and every dispute costs us a fee from our payment processor, whatever its outcome.

Raising a dispute is your right, and it does not affect your statutory rights. While it is open we may suspend access to the purchase. If the dispute is decided in your favour, the purchase is treated as refunded (section 10). We will not close your account over it, and it does not affect your free courses.
